I filed a psychological stress claim after long-term bullying and intimidation at work. A few days after filing my claim and returning to work I overheard a supervisor lying to the insurance adjuster from the break room and experienced the worst chest pain I had ever felt. Disoriented, I left work and tried to go to the urgent care center where I had obtained my first report. (I was not present enough to realize this should be an ER visit, and my supervisors refused help.) The insurance adjuster called me. When I said I was seeking care for a medical emergency, he said he would deny my claim and called ahead to tell the center that they could not bill the insurance company for my visit, endangering my life for all he knew. My first attorney seemed sharp and experienced, but barely listened to what had happened and wanted to shoot for a quick settlement. I tried to ask clarifying questions but he kept bringing the conversation back to high-pressure sales tactics, which worked in my vulnerable state. He miscommunicated something and got a low settlement offer. He pressured me into the settlement, but after I'd had some time to process, I changed my mind. His furious reaction caused me to look up his license on the CalBar website, where I was horrified to discover a notation of disciplinary action involving moral turpitude. He tried to intimidate me into dropping him as my attorney rather than do any more work. He claimed that we had agreed he would get me a settlement and that he would "step out" if I wasn't satisfied. I asked him to negotiate an adjustment to ensure I would have some medical care and he refused and filed a motion to be dismissed. I realized he had wanted to exploit my situation. (I learned later this is a common practice of unethical work comp attorneys.) He had sent a template demand that he hadn't even edited correctly. Desperately I called any work comp firms I could find, but found that most of them don't want to take a client who has already hired another attorney. Barkhordarian Law took my case, and the attorney who signed the representation agreement with me spoke to me like a human being. She seemed to want to prepare me for the possibility that I might not like the eventual outcome, explaining the high burden of proof for psych claims and the invasiveness of discovery. I said I was just trying to survive in filing my claim, and she nodded sympathetically. I worked primarily with Anthony Candelaria and Valerie Govea. They were wonderful, supportive, responsive, and very experienced with their work. When Anthony called me about settlement offers he explained them in detail and was incredibly knowledgeable. He negotiated very aggressively, even obtaining a voucher on top of my settlement lump sum to help me out more, even though it wouldn't contribute to the contingency fee. Just pure kindness and advocacy on his part! He helped me settle for almost three times the offer my first attorney had obtained without putting me through a deposition or a hearing. Valerie found doctors who would see me with a denied claim when I wasn't well enough to do it myself, which probably saved my life. Importantly to me, everyone acted ethically and no one ever pressured me. When I was concerned that filing something unrelated to work comp might compromise my claim, Anthony explained how it could, but told me to prioritize my safety in deciding. My team encouraged me to set goals and work on something important to me. I'm sure that continuing to languish would have shown greater injury, but I didn't want that, and neither did they at my expense. Insurance adjusters try to take advantage of claimants, and quality legal representation will protect you. The reason many firms refuse to be a subsequent attorney is that each attorney can claim part of the contingency fee. This means less money for the successful firm! Even knowing that, Barkhordarian Law fought for me, took the high road the whole way, and succeeded. Thank you so, so much. Learn from my mishaps and choose them first!
Case is now going for 4yrs. At the start everything was great really helpfull. Heather would keep me updated with everything that was going on even when nothing new she would still let me know, Now i have been thru almost 5 diffrent lawyers (i wonder why they keep quiting) the lack of communication is out the roof last time i spoke with someone was back in june/july of 2024. No updates, only thing i get is email to sign & everytime my seattlement keeps getting smaller & smaller. Front desk is no help i dont even know how many times i have left messages to pass down & still nothing 3/11/25
